Terms & Conditions

SECTION 1 - Introduction

1a. The terms and conditions presented here apply to your use of our website and to each prize draw on this website except where stated otherwise.

1b. The website and prize draws are operated by K&W Promotions Ltd trading as “The Big Prize Company” (herein on these T&Cs also referred to as "us", "we" and "our"). Our company information can be located at the bottom of this document.

1c. These terms and conditions may be changed or updated by us at any time. Check them thoroughly as they apply to any and all use of our site or any prize draw you enter from the effective date shown above these T&Cs.

 

SECTION 2 -  Entering our Prize Draws

2a. Employees of K&W Promotions and anyone directly connected to our draws are ineligible to play.

2b. To be eligible for our prize draws you must be over the age of 18 years.

2c. To be eligible for our prize draws you must be a legal UK resident.

2d. As well as complying with all our terms and conditions you must comply with all applicable laws, regulations and requirements on our website. Anyone breaking any terms and conditions or applicable laws will be ineligible to receive their prize and the prize may go into a new draw.

2e. You must register a (free) account on our website to proceed with our prize draws whether you take part online or send in a free entry by post. Purchased entries must be made via our website or, if specified, through our alternative channels such as our Facebook page. 

2f. Free entries must be made via an unenclosed postcard by first or second class stamp to our registered address which is K&W Promotions Ltd, Office 15653, 182-184 High Street North, East Ham, London, E6 2JA and must include your full name, address, contact email address, contact telephone number, your date of birth (to confirm you are over 18 years old), the single draw you wish to be entered into, and confirmation you accept our terms and conditions. The contact details must match your details in your registered website profile. You must be the account holder registered on our website not entering on behalf of someone else.

2g. A free postcard entry to our draws only gives you free entry to one specific draw which you must specify. You can also enter any other draws for free by sending separate postcards to the same registered address above for each you wish to be entered into.

2h. Each free entry postcard must be received by us by the closing date and time of that specific prize draw in order to be entered into the draw. We will email your draw number to you to confirm free entry and also update the prize raw entry list. You will stand the same chance of winning as any of the paid for tickets. If you receive no email confirmation from us and your name is not on the entry list by the close of that prize draw then you have not been entered for the draw. We will not enter into correspondence as to why the entry was not received or processed.

2i. Any free entry postcards received after the closing date and time of the specific draw will not be entered. We can take no responsibility for any postal entries lost, delayed or damaged by the postal courier or the sender or that are not clearly legible or do not match the account holders details on our website. You are responsible to ensure the correct first or second class postage is paid for the mail.

2j. You must keep your contact details in your website profile up-to-date and ensure the contact information is entered correctly. If we are unable to contact you within 48 hours about your win because you entered your contact information incorrectly or have not updated it then we will not try again after this time. If we don't hear from you within 7 calendar days from the draw you will forfeit the prize and we may put the prize in another draw. There will be no ticket refunds.

2k. Entries must be sent by the registered account holder whether through our website or free postal entry. No third party purchasing or use of bots or other automated methods.

2l. Whilst you may enter as many different prize draws as you wish each prize draw is limited to a maximum number of tickets per prize draw which is 100 tickets unless stated otherwise in a specific competition. (We sometimes run very limited number ticket draws and these will specify what the individual member limit is within the competition information).

SECTION 3 - Subscriptions

3a. If you subscribe to one of our ongoing subscription packages we will automatically bill and enter you for the same number of tickets into the next draws for that prize for the subscription period chosen. We cannot refund once we have taken payment which will occur on the specified payment date but you do have the option to cancel the subscription or amend the amount of ongoing tickets going forward at any time before the payment is taken. We will send a reminder 7 calendar days before payment is taken.

3b. You authorise us and our payment provider to place a hold or charge on your payment method for the relevant amounts or otherwise take payment whenever payments are due in accordance with this agreement. It is your responsibility to update your payment card details as necessary.

3c. If payment fails or declines you will not be entered into the draw. It is up to you to ensure the details are correct and the funds available at the time the payment is due.

3d. We may at our discretion change our subscription prices as business needs require for any reason. We will give 30 days' notice by email before any such price change takes affect. You may end your subscription without any cancellation fee if you do not wish to proceed at the new price. It is your responsibility to cancel your subscription if you wish to otherwise payments will continue to be taken at the new rate.

SECTION 4 - Closing a Prize Draw

4a. All of our prize draws will close at the time and date specified on our website for each individual draw unless the amount of tickets for that draw have already sold out earlier in which case the draw will close earlier.

4b. We may extend the prize draw up to a maximum of three times under exceptional circumstances. 

SECTION 5 - The Draw

5a. The winner is selected using Google Random Number Generator or a similar service if that is unavailable for any draw such as for downtime/maintenance. The draw will be livestreamed on our YouTube channel and streamed on our Facebook page and within the Members Only section of this website where possible unless there are any technical difficulties or downtime outside of our control.

5b. The prize draw will occur on the date and time specified within the draw details unless technical or other issues beyond our control require us to move the time or date and we will post on the website and social media if and when the date and time changes as soon as we possible can nearest to the original intended draw time.

5c. We will post the details of the winner on the website and on our social media accounts and email the winner within 48 working hours of the draw taking place unless unforeseen difficulties or technical issues delay this in which case we will do so as soon as possible. It is your responsibility to ensure your contact details are correct for us to make contact to confirm win and arrange delivery to you.

5d. The winner has 7 calendar days from the date of our email confirming the win to accept the win and supply any further details required to ensure successful completion of delivery including any proof of age or identity to ensure you are entitled to be in the draw, confirming correct delivery address or supply bank details for any bank transfer of cash prizes to you.

5e. If the winner does not make contact by email within the 7 days of email notification from us about their win to accept and confirm any proof or further details requested then we are under no obligation to make any further attempts to contact the winner and may at our discretion cancel the prize award and use the prize in another draw. We will not enter into correspondence about this decision and our decision is final.

SECTION 6 - The Prizes

6a. The prize for each draw is specified on our website and social media. We will not substitute one prize for another of equal value but we reserve the right to substitute the cash price equivalent in exceptional circumstances if the offered physical prize becomes unavailable, lost, damaged or otherwise not deemed fit for purpose by us. The cash equivalent value is stated within each prize draw.

6b. The winner is however free to choose themselves to take the cash equivalent alternative to the original prize if they prefer to do so of their own free will. The winner must state this preference by email when contact is made after the win.

6c. Whilst we take all reasonable care to describe and show the prizes for each draw you acknowledge and accept that there may be minor differences between specifics between how they are described and appear on the website and social media and the actual prize received. Taking for example a £100 Amazon gift card prize, the physical card comes in many variations. We may have an image on our website of an orange Amazon card and the one sent may be white, black, or multi-cultured/patterned etc depending on what is available but it will still be a valid £100 Amazon gift card. 

6d. We include free tracked postage for all prizes to UK addresses only that match the address for the account holder on our website. If you want to change the address to another UK address this can be arranged but will not be free. The postage charge will have to be agreed depending on the weight and size of the item. You can have it sent to the registered address and forward on yourself to any other address once it is in your possession. For larger items we may undertake to deliver it personally at an agreed date and time.

6e. We reserve the right to withhold prizes until we are satisfied that the winner is entitled to the price under our terms and conditions. If the winner is not deemed entitled under these terms and conditions the awarded price will be cancelled and the prize may be entered into a new draw. Our decision is final and we will not enter into correspondence about our decision.

6f. If you do not or are unable to provide any required proof of identity at the point of delivery or the prize cannot be delivered to the address by the courier or ourselves as agreed after two delivery attempts then you may be required to collect the prize in person from our specified location within the UK at your own expense within 30 days. Failure to do so will result in us cancelling the award of the prize and may enter the prize into a new draw. We will not refund the ticket price or any other costs incurred. Our decision to cancel the prize will be final and we will not enter into correspondence into this matter.

6g. All prizes are provided "as is" and without any warranty, undertaking or promise from us as to their quality, condition, value, suitability unless otherwise stated. We do not take out insurance on prizes but you may choose to take out any relevant insurance on the goods if you so wish so long this is arranged by email with us before the item is posted or sent.

6h. All prizes are subject to any relevant terms and conditions of the manufacturer or supplier of the prize and to any terms and conditions of the courier delivering the prize.

6i. The winner is responsible to pay any relevant taxes, insurance or registration of their prizes as required by law. For example if the prize is a car then the winner must arrange to properly and promptly register the vehicle with the DVLA and tax and insure the vehicle or SORN it if keeping it off the road or looking to sell or transfer it straight on etc. We are not responsible for these matters or any injuries, claims or legal matters that arise from not following the relevant laws or safety instructions.

6j. The winner is responsible to ensure they have everything they need to benefit from the prize won. For example if you win a holiday it is the responsibility of the winner or whomever they gift the prize to ensure they have the relevant passports, visa, travel documents etc to travel and take responsibility for their own travel insurance or anything else required that is not included with the prize itself

SECTION 7 - The Welfare of Players

7a. Here at The Big Prize Company we strongly encourage responsible participation in all of our prize draws. Our wish is to build a fun welcoming community and spread a bit of joy in these austere times.  We do not encourage compulsive or excessive play. If you feel like your participation is becoming a problem or concern to yourself or to others or you think some other members' playing might be becoming an issue in our community we strongly encourage you to seek or recommend support from one of the relevant support organisations like Gamble Aware, whose website can be found here at www.gambleaware.org or feel free to email us at admin@bigprizecompany.com about any concerns you have in this matter. We will always endeavour to help where we can.

SECTION 8 - Our Rights

8a. We reserve the right to make the final decision in all matters in connection with our prize draws and no correspondence will be entered into regarding our decisions.

8b. We reserve the right to reject or cancel your prize draw entry or your winning a prize.

8c. We reserve the right to close and/or delete your account on our website (inclusive of any and all content in it).

8d. We reserve the right to cancel any prize draw in exceptional circumstances. Where we have to cancel a draw we will fully refund all entry fees via the method used to pay us.

8e. We reserve the right to take down part or all of our website or social media where and when necessary either temporarily for maintenance, repairs or updates or permanently should the need arise.

8f. We reserve the right to temporarily or permanently ban anyone from our website and social media and temporarily or permanently ban you from entering any of our future prize draws along with the above rights if we feel you have behaved inappropriately towards either our staff or any other users of our services here on the website or anywhere on our social media, if we feel you have broken any of the terms and conditions stated here, if we feel you have attempted to cheat, deceive or fraudulently participate when illegible or been previously banned, set up multiple accounts in different names, misuse our discount codes or information, are participating in harmful behaviour or attempt to harm our business including but not limited to the following behaviours;

* breaking the law or infringing our or anyone else's rights;

* harassing our staff, suppliers, delivery agents or other members;

* sending, displaying, linking to or storing any unlawful, copyright infringing or otherwise inappropriate content;

* use of offensive, abusive, discriminatory or obscene language or images;

* deceiving or misleading our staff or other members;

* provide, share or disseminate our or any other members or any outsiders' personal information under any circumstances if they are under 18 years of age or without our or their express written consent if they are over 18 years of age except where legally permitted to do so;

* use our website, social media or services to impersonate or deceive anyone;

* use our website, social media or services for any of your own or a third party's own commercial interests or to compete with our services;

* disrupt our website, social media or services by way of spamming, viruses, phishing, doxxing, imposing unreasonable loads on our website to cause issues, or bypass and interrupt our security features and systems;

* make false or malicious statements that harm our reputation;

* gain unauthorised access to any part of our or our suppliers and partners' systems or data including but not limited to passwords, card information, names, addresses, procedures, documents, banking or any other sensitive data;

* intercept or modify any communications or data;

* cause any damage to any of our systems, property or reputation;

* attempt, encourage or assist any of the above behaviours.

In these instances we will refund any active prize draw entry fees you have paid where practical without opening ourselves up to any danger in further interacting with you. In any of the above instances we may involve the police or other agencies where we feel it is warranted.

SECTION 9 - Discount Codes

9a. Discount codes when and where provided are for one single use per registered member. They cannot be transferred, reused or abused by such acts including but not limited to creating multiple accounts or altering your member profile to appear a new customer etc. Any misuse of our discount codes will see tickets cancelled at least and possibly members banned at our own discretion.

SECTION 10 - Content added to our Website or Social Media​

10a. You the user are fully responsible for any content you or anyone on your behalf adds to our website or social media including but not limited to profile pictures, reviews, comments or ratings but enable us to use them in so far as is necessary for promotional purposes should you win.

10b. Any reviews, comments or ratings you leave on our website, social media or third party review services should be honest, genuine and indepentant opinions but may not be malicious, false or misleading in attempts to malign our company, staff or services.

10c. We reserve the right to reject, suspend, block, remove or alter content posted to our website or social media.

10d. We reserve the right to share or reuse for marketing purposes any reviews, comments or ratings about us or our services.

10e. We reserve the right to pass on to the police or any other relevant authorities or organisations or complainants any content or information that we are legally permitted or required to pass on.

SECTION 11 - Advertising

11a. At times we may display or promote or link to other peoples', companies or organisations' services. This does not constitute a recommend or endorsement or financial link. We are not legally responsible for any of their actions, statements or services. You use them at your own risk. 

11b. We will be giving to charities that may change in terms of amounts given and charities supported but we will publicise who we are giving to, what percentage of our profits, and when or if the charity supported changes.

SECTION 12 - Your Account with Us

12a. Your account and profile on our website and social media is solely for your personal use only, you must not allow anyone else to log into or in any way use your account. Each service user should create their own individual account with us and stick to our terms and conditions around age and UK residency.

12b. We do not allow creation of more than one account for an individual to get around ticket buying limits, to harass anonymously, get around bans or for any other purpose. If you have log-in or system/account issues contact us at admin@bigprizecompany.com in the first instance. Do no create a new account unless recommended to do so by The Big Prize Company admin​

SECTION 13 - Closing your Account

13a. You can close your account with us at any time for any reason by emailing us at admin@bigprizecompany.com 

13b. Closing your account with us does not entitle you to a refund for any active prize draws even though you won't be able to benefit as a winner as we will not be able to make contact. However depending on the circumstances we may feel a refund is appropriate entirely at our own discretion. Our decision will be final and we will not enter into correspondence about that decision. 

13c. Other than closing or deleting accounts for breaking any of these terms and conditions we reserve the right to close and/or delete any accounts that have been inactive for a period of at least 12 months since last log-in, at our discretion. If your account has been deleted for this reason you are free to create a new account.

SECTION 14 - Liability

14a. Nothing in this agreement in any way limits or excludes our liability for negligence causing death or personal injury or for fraud or fraudulent misrepresentation or for anything which may not legally be excluded or limited. In this section, any reference to us includes our employees and agents.

14b. We are not liable for any loss or damage where - 

* there is no breach of a legal duty owed to you by us;

* such loss or damage was not reasonably foreseeable (meaning it was not an obvious consequence of our breach or not contemplated by you and us at the time we entered into this contract);

* (and to the extent that) such loss or damage is your fault, for example by not complying with this agreement; or

* such loss or damage relates to a business of yours.

14c. You will be responsible to us for any reasonably foreseeable loss or damage we suffer (including claims made by other people) resulting from your breach of this agreement.

SECTION 15 - IP (Intellectual Property) Rights

15a.  The intellectual property rights in all material used on or in connection with our website and social media are owned by us or our suppliers, partners or other users. For your personal use only, you may view such material on your device. You must not otherwise use such material including copying, publishing, selling or altering it or taking extracts from it without our specific prior written consent.

15b You must not collect, scrape, harvest, frame or deep-link to any information on our website without our specific prior written consent.

SECTION 16 - Website & Service Availability

16a. We cannot guarantee that our website or social media accounts will always be uninterrupted or fault-free. There will be times when, with or without notice, and without liability, we have to suspend part or all of our website and social media for repairs, maintenance, improvements and updates or other technical reasons. We will always endeavour to keep any down time as short as possible and carry it out at quieter periods where possible.​

16B. We are not liable for any failure to perform or any delays in performing any obligations under this agreement if the failure or delay is caused by circumstances outside of our reasonable control including but not limited to third party telecommunications failures and delays, weather related issues, national or international crises, acts of war or terrorism or during pandemics.

SECTION 17 - Our Legal Duty to National Laws and Acts in the UK

17a. We comply with all relevant and appropriate conditions applicable to us under the Gambling Act 2005 in regards to skill prize and free entry route competitions.

17b. We comply with all relevant GDPR acts in the UK.

17c. We comply with all relevant parts of the Consumer Protection from Unfair Trading Regulations 2008.

17d. We comply with all the relevant Advertising Standards Authority  CAP Code rules.

SECTION 18 - Personal Information​

18a. You agree to our use of your personal information in accordance with out Privacy Policy which can be updated at any time.
